I just did a quick search and it looks like ESAs are actually covered under Federal law not state law, which is good.
I'm a paralegal and would be happy to search the laws further (especially tenant law in your state) for you should you decide to pursue this and get push back from your landlord.

Hopefully we can all put our heads together and think of a way to soften Mr. Landlord.

I actually lied to my new landlord of 3 years, and pretended that Simon was sleeping inside, just in case we get Chestnut a friend in the future.  I don't think he'd say anything, he rarely stops by but he's not like my old landlord who was the sweetest.

I feel things will work out for you and your sweet boy.

Thanks you guys! I just don't think I can do the certification thing. He knows he's a stay that came up here. Plus, would take too long to even get in to see my nurse practitioner, & as said, don't know if that's even something he can do, & he's all I have.
I looked at tenant rights a while bk for NC, & we don't have much. Also keep in mind, because theses are his houses he rents out, & I have been here for 17 yrs w/ o a lease. I just have to try ,& hope he will soften up.

@margd, thanks, but have no idea where he even goes outside.
He hasn't used the box since kept in for the storm, I didn't think I had anything, but had kept the old litter bag, since it zips up, to put poop bags in, until I take out the trash. PRAISE GOD!!!! I did have one! Dumped it in like you said, & showed hi. & He covered it , & is peeing now!!

Thank you for all the undeserved thanks!  It was @mazie  who suggested priming the pump with an old poop.
  I suggested using some dirt from outside.  Anyway, great news that it worked.

I totally get that. I was thinking about your situation being a little delicate because you don't have a lease. Just wanted you to have the information so you know that you are well within your rights.
Not having a lease can be good and bad. Most tenant law protects against retaliation (i.e. Raising your rent) but I'm not sure if that protection is only afforded to you if you are in a lease and would be a state statute not a federal law. Because I'm curious, I'm going to poke around a bit further into NC tenant law just to see what I can find.

New News,

I was just outside talking to my neighbor two houses up, at the front of the driveway. She walks her dogs down here & back. (She has rented from him for YEARS, longer than me).

She said to not worry about what my landlord said, that he would soften up after a while, forget about it, etc..  That I should've just said that He only comes up to visit, that he's not mine. I told her what I already told him, & she said, not to worry about it, that he isn't going to do anything. I kept telling her that no matter what I offered, he just kept coming back w/ no!

I asked about the guy upstairs, next door, & she said that he had a girlfriend that had a cat & was gonna move in w/ him, & should he ask the landlord, & she told him no, & that she could leave anyway. Well, I guess two days after that she did, so it didn't matter.(confusing, I know, just repeating what I was told)  She said he doesn't want a cat, works all the time, etc.. so doesn't know why the landlord would say that.

He was just using everyone supposedly said against me!

She said to just keep Sammy out of the porch window & to close that shade when I leave, so no one can look in. 

I get what she's saying, but I told her I just can't take that chance, because I can't afford anywhere else to live. She still kept saying, I wouldn't worry about it. To even say, I let him back out, to where he came from & keep him in.  I'm just afraid that my landlord will get mad & kick me out, if he found out! I'm just in a horrible position!! 

I can see what she's saying, but just don't know how it would play out.  I just don't know if I can get around it......
Kelly, I think this is a great piece of news.

Your landlord can't show up and demand that you get rid of Sammy or move out right away. He has to tell you in writing and give you 30 days to find somewhere else and move out. Before it comes to that he would have to tell you in writing that you have to re-home Sammy or else.

I lived in a No-Pets apartment for over a year with my first cat. We kept her hidden when the fire alarm people keep round to do their 6-monthly checks, which was the only time anyone official stepped into the apartment. I knew of at least two other cats and a dog in the same building. As long as there were no complaints and you were discrete you could get away with it.

What I'm saying is, don't feel that you have to re-home Sammy right now. Look around for a new home for him if you're really worried about your situation, but don't feel that he has to leave immediately. It sounds like your landlord will probably turn a blind eye to the situation now that he has told you that he doesn't allow pets. In the mean time you can look for a new home for Sammy, or a better place for yourself or a nice man with his own house.

I'm actually now wondering what is in her lease agreement. Does it specifically say no cats? Does she even have a written lease agreement?

No, I've never had one in the 17 yrs I've lived here. He just told me he didn't do them, so if I needed to move to just give him 30 days & vise, versa. Probably because if he gets some bad renters, he can just kick them out.
He is an older southern, redneck, barber. He doesn't do paperwork, etc... I doubt he uses a computer. I don't know. Once I needed a verification of rent amount for something, & when I asked him for it, he told me if I typed it up, he would sign it.
So yes a lease is good & bad.

@HelloMissKitty, thanks, but back a while ago when he threatened going up on rent , I was all worried, so looked into tenant laws & there is t much. Not that apply anyway. Because it's his property, he can pretty much do what he wants. So.....
I am just going to have to hope & pray for favor. I am going to have to work it out here. I can not afford anywhere else. (I've looked!)

Well, it's his private property. He did verbally tell me no more pets here, for anyone. It was again, after I had called to complain about the visiting dog downstairs barking for 2 hrs. after being left alone, while they went out for the evening. This was a few months ago. I was a little afraid of that, but hoped he wouldn't notice, or even be an issue.
So I hate that I did that, because now, it's biting me in the ass!

I don't think I would say anything about a lawyer, it would just make him more mad, & he could raise rent because of it. To mention a lawyer would be like taking it to the next level, & he would definitely be pissed off!! I can't do that.
Weather he lets it go or not, I don't know. I can't trust that. He's the type you don't know how he's going to be, "who" you're going to get. He is usually nice, especially if you rarely need anything, don't bug him, etc... I would usually get my dad to fix things, if it wasn't anything too big, because my dad does a better, faster, & cleaner job than his guy. He knows this, so I also think it's why he's left my rent alone for years, as well as all the painting i've done, & how clean I keep it. Then, sometimes, he can be the way he's being now!

Yes, it is crazy how this is made into such a big deal.

I think my next thing to do at this point, my next move, so I know which direction I am going in after, is to come up with a small statement that says the neighbors do not care if I have a cat, nor do they want pets, or plan to get one. Then have them all sign it.
My only worry is the blind people downstairs. I will probably just casually ask them, "Hey, you guys don't care if I have a kitty do you?" and see what they say. If they say no, then good, here, sign this!
If they bring up the dog situation, I'll just say, "Hey, I don't care if anyone visits w/ a dog, as long as they don't go off & leave it, so it's barking until they get back." Hopefully they won't get nasty! They can be that kind of people. Like they get off on bitching! SO, w'ell see.
Until then, I am trying not to stress as much, because all weekend I was a big ball of anxiety, worry & stress!!!! I was wishing I had something stronger than my Holy Basil capsules to help relax. LOL!

@HelloMissKitty  ,  I finally just looked at the attachment you posted. Unfortunately, that would not work for me, as I have no history, or have any of the disabilities listed. My landlord knows this as well, since he's known me for 17 years.  He would also know it was a reach behind his back, so to speak & just make it worse.    Thank you though.

I have a thought.  One of our members who is super computer savy start a THE CAT SITE petition where we as members can sign our names in your behalf, directed to your landlord??   With ANNE'S permission first, of course.  Just an idea, a good idea  if this would be possible??  Worth a try?  What do you all think??

This may be a long shot and I am not sure if Angels mommy would feel comfortable doing this or has already tried this but I am going to put it out here. You have mentioned that you have clients you clean houses for and do massages for.  Are any of these clients also considered to be personal friends?  The reason I am asking this is because not all people looking to rent out places advertise. Also you may be able to find places that just became available but may not have been advertised yet.  If you have clients you are comfortable sharing your personal situation with maybe they know of someone who is looking looking for someone to rent property.  Sometimes people are more comfortable finding tenants going through people they know instead of advertising.  Perhaps someone has a friend that is a landlord that would be willing to work with you on what you can afford and be willing to accept Sammy.  I hope my suggestion does not make Angels mommy uncomfortable.  I know you have said you do not want to have a room mate but perhaps someone out there knows someone who has a big enough space to rent that you would have your own privacy and space so you would not feel like you have a room mate.
