The answer to your question is yes and no. Yes, because you can try anyone in absentia. No, because the likelihood that any of these people will be brought to justice for their crimes is nil.

On one part I really want this guy to be convicted, because he has done some evil. On the other part I am concerned about the political and economic reprocussions for Canada.

A point of clarification regarding the thread title: Canada is not doing anything. There is a lawsuit being brought in Canada, but the plaintiff is not Canada; it is 5 individuals, one or more of whom are Canadian citizens. They can bring a lawsuit, and it appears that it has met all the criteria for proceeding; whether it will do them any good is another story.

Based on the article, it seems that there's at least a reasonable expectation that the judgment will go in their favour, but what is the likelihood of their collecting damages? Slim to none, if you ask me -- and I think "Slim" just left the room. I'm guessing that all the benefit they'll get out of this action is publicity.

He doesn't have to be there. You can sue anyone and they don't have to show up, but it looks bad for them.

I think the lawsuit seems to be primarily to bring attention to China's human rights abuses. Maybe the victims can't collect damages (although if they win, then maybe they can somehow attach some of the defendants' Canadian assest, if there are any) but if people rebel & boycott Chinese goods, then there could be an impact that will help other unfortunate Chinese prisoners. As they say, "Power to the masses"
