The confession is being thrown out. couey (not even worthy of capital letters in his name) took her from her bed, raped her, kept her in a closet, and (this part is even hard to type) buried her alive.
Aparrently the interview took place while Jessica was still missing. The police were between a rock and a hard place. In case she was still alive, getting him a lawyer could have wasted precious time.

Now his lawyer wants the discovery of Jessica's body thrown out too because couey told the police where to look!

I think those officers did the right thing by getting him to talk. They couldn't risk not letting him talk for the chance that Jessica might still be alive. Like they said. It was a no-win situation.

I think that they will have enough to convict this sicko anyways.

As frustrating as it is, the judge really had no choice but to rule as he did. I really don't think it will hurt the case much, as they have his record, the DNA, and the body.
I understand the police, though. There was a very similar case here not long ago. A young boy was kidnapped and held for ransom. The suspect was denied a lawyer and threatened with physical torture, so he confessed. Unfortunately the boy was already dead. Heads rolled, and the confession wasn't admitted, but the killer was convicted anyway.

Boy, I hope you guys are right. This case hit me hard. I remember seeing Jessica's sweet face on TV before anyone knew what happened to her.

I can't imagine he would live long if he was released though...

I understand that defense lawyers have to do their jobs. I just can't fathom how this one can.

The judge, though he did throw out the confession and I can understand why....though I don't agree with it, will not throw out the discovery of her body, along with that they have his DNA and among whatever other evidence is available to the prosecution, I hope they send that sick man away for a very long time....

I agree with you! I can't remember but wasn't the killer out on parole when he killed her? It was either that or he was some sort of an unregistered sex offender that the police were looking for.

I feel so bad for her father. I know that he must be going through hell right now; I'll keep him in my thoughts and prayers so that he will find some peace.

it would be hard to find peace knowing the type of death your child had. I mean this guy brutally raped this girl then he tied her up, put her in a garbage bag and buried her alive.

If that had been my daugther, and I had the means I would probably kill the man myself. This is exactly why I'm for the death penalty. Because these guys get put in jail, get out on parole and do the same or even worse things than what they got sent to prison for in the first place.

Sex offenders should be registered and people should be notified if they have a sex offender that has preyed on young children living in their neighborhoods.....for the children's safety.

Cause they don't change, even if they say they do....those impulses are always going to be there for them.

Knowing this family personally, and what they've went through it's been a HUGE upset.........I met them when they held a conference and her father was the sweetest, most loving man. They are deep in prayer that god will see what this man has done to thier baby girl and justify it

Her father seems so kind. I hope that he hooks up with John Walsh and they do a tour when he is up for it.

Yes, he was on parole for another sexual assault on a child. He didn't kill the other one; apparently he thought he needed to cover his tracks more this time. He is a total waste of space, and a waste of human flesh. There is more than enough evidence without the confession to convict him and sentence him to death under aggravated circumstances.

That is IF he doesn't get killed in prison, most prisoner's don't smile on child assault of any kind (so I've heard) and if they find out what he's in for, he's a goner anyways.

I just cought up with this thread and i can't say enough how sad it is how that little girl died and was treated so horribly. My heart goes out to her famliy. That being said, there is a wonderful website out there that allows US residents to type in their address and view pictures of all the registered sex offenders in their area. It tells you what they were charged with , how far they are from you, and how far they are from a school....it's wonderful- i used it to look up my house, my boyfriends house, and one of my sisters who has 3 small children. At least now we can look at the pictures and try to familiarize ourselfs in case we ever run into them. I don't think it's wise to panic- but i do think it's wise to always be prepared. I hope this helps:

I've used that site before but there are a few people that don't have access to the internet and the like....

But also....you know what goes around comes around eventually. It's what keeps me going. Especially after what my ex did to both me and our little baby (who happens to be my 6 year old). He was never prosecuted for breaking her little arm when she was 9 weeks old and that is thanks to the military investigators.

I should start an IMO thread about child abuse/domestic violence honestly.

I believe that the case will be able to proceed anyway. I certainly hope so, because it is also important that everyone's rights as a citizen be upheld, for the protection of the society and this case is so horrific that the entire nation cried.

That whole situation is so sad, and makes my literally sick to my stomach. No one should have to be put through that...the poor girl nor her family and friends.

I would love for the death penalty to include doing to that person what they did to another...I wonder if that would stop some of the horrible things people do to others.

LMBO....oh gracious. Well I think that they were desperate cause they knew there was a chance she was still alive...and considering that she was buried alive I don't blame them for pressing, getting an attorney involved slows things down, it's unfortunate that they didn't find her alive actually because then things might be going differently...know what i mean? Justifying the cops' actions.

I just say that on the news! In this case, I would be perfectly happy with them saving the cost of a trial and just throwing him to the prison population with no protection. He wouldn't make it long.

This story was all over the news here in Florida. I will be suprised if they can find anyone who isn't familiar with the case and who has not have all ready formed an opinion.

It's going to be very difficult to find jurors in the U.S. who haven't been overexposed to the case. I live in Europe, and heard a lot about it!

Well, then give him a bench trial but then they can say the judge is biased....

This is the kinda case that makes me so angry at our justice system. You get a confession, you get proof that he did it, he tells you where the body is, and you can't use it cause it was obtained illegally?! It doens't make it not the truth just cause they for example, go without a search warrant, or get the confession w/o a lawyer.

I too wish for an eye for an eye for this guy!
