thats odd because your auto insurance is supposed to cover your injuries and then any award you get is simply pain and suffering. My father was hit by a drunk driver, hospital bills were around 250,000$ (he was in the hospital for 2 months) and the award was 100,000 and My fathers lawyer got 25% (25,000) so he still got around 75,000$.
I think it did, i got a certain amount and every thing was paid through it, and I got what was left over. The lawyer got 33 1/3 % I think.I was only 15 when it happened and my mom took care of it, so it may have been differently I guess. The girl who was driving the car I was in only had liability and the passenger of the other car claimed first, he was pretty messed up, and had to have reconstructive surory on his face, he got all that her insurance covered pretty much, I guess, and it ended up going back on my mother insurance she had at the time of the accident (which I thought was strange since her car wasn't involved) but, my mother lied and ended up getting 5000 too, so who knows mabey she lied about more to me. (I guess you are entittled to 5000 for a car, before getting the money, my money went into an account untill I turned 18 and she claimed to need a car to take me to DR. appointments. I only knew that because she got a new van around the time it all got settled, and a few years later, my boyfriends step daughter was in a bad accident and was able to use up 5000 to get a car with.)
I live in maine, so i'm sure insurances vary, and being a drunk driving accident it may be different then just an accident that no one was charged for (no one was drinking, or speeding, the girl I was with just didn't see the car comming and turned in front of them and we hit head on)
