They also can't ask you what sexual orientation you are, what race you might be, if you have a disability, if you are married, etc, etc.
It should have nothing to do with your ability to do your job.
As to the original situation: I wouldn't have risked stepping up to a mother like that. I am a mother and I can bet you people would never come up to me in this situation because I wouldn't let my child get this out of control.
If I did, I would probably not be the kind of mother that its easy to discuss such topics with.
I would've taken the manager aside, like others have said.
