I got a call from my sister, Ashley this morning who was crying her eyes out. She had just moved out of my dad's place down the street in with her bf and she was on her way back to my dads because he called her to come to the farm ASAP. Two pit bulls got onto my dad's property this morning at 6am, and killed my sister's 14 year old daschund. My sister has raised "Itchy" since she was 5 years old...the dogs also hurt Kenny (their collie) really bad. My dad shot one of the dogs (it was still dark out, he didn't know what was going on). The owner is now threatening my father. I am upset because if this happened an hour later, the dog could have attacked my little sister when she went out to catch the bus for school. I hope this can be settled reasonably, but the way things look it's gonna be a battle. My dad doesn't need this with his heart condition.

Oh my gosh Candie - that's horrible! May Itchy rest in peace.

I just looked up Texas' Cruelty statutes, which may or may not apply since I'm not sure if the "owner" of the pits is threatening legal action if he's talking about criminal action or not. He'd be hard pressed to get charges pressed based on this:

(e) It is a defense to prosecution under Subsection (a)(5)
that the animal was discovered on the person's property in the act
of or immediately after injuring or killing the person's goats,
sheep, cattle, horses, swine, or poultry and that the person killed
or injured the animal at the time of this discovery.
(f) It is a defense to prosecution under Subsection (a)(8)
that the actor tripped the horse for the purpose of identifying the
ownership of the horse or giving veterinary care to the horse.
(g) It is a defense to prosecution for an offense under this
section that the person had a reasonable fear of bodily injury to
the person or to another by a dangerous wild animal as defined by
Section 822.101, Health and Safety Code.
It doesn't specifically cover the situation, since the dogs weren't livestock, but still. If the "owner" is threatening your father in any other way, just call the police and nip it in the bud.

I'll definitely keep your family in my thoughts.

Heidi, I know that my dad was protecting Kenny and especially Jake and Bubba (the lab and the younger daschund). My dad had the right to do that since the pit bull was on his property. I am not worried about my dad getting in trouble, I am more concerned for their safety because the owner of this dog seems to be bit on the crazy side. I know people get really defensive when their animal gets killed because of something like this. I just told my dad to be extra careful by putting more locks on the door, having Karen (my stepmother) stay outside with Ally when she waits for the bus, and bring the other dogs inside for awhile. Thank you for the info, makes me feel better

I am really sad about Itchy...she was my neck warmer when I lived with my dad for a year. I just hope she didn't suffer

How terrible!
I'm so sorry about Itchy.

If that crazy guy threatens your dad or your family, be sure your dad documents any and every threatening word, and reports it to the police. Depending on where your dad lives in Texas, it's also possible the man could be in trouble for allowing his dogs to roam and attack people's pets, and you may be able to hold him responsible for Kenny's vet bills.

Sending prayers for your family to stay safe & strong
and for Kenny to get better soon

Thank you TK. I seriously believe that man is liable for Itchy and Kenny. I know here in Houston that you are suppose to have your dog on a leash, in the yard or your house, but I think it may be the same in Montgomery, TX where they live (an 1 1/2 hour drive from here). I'll be calling in an hour to check up on everything. I'll keep you guys posted. You all help me in the times I need you guys the most, and of course, God does too with some great prayer. Thanks friends

Oh, I am so sorry to hear this. Frankly here, when dogs do this, they are quarantined, so that other dog really should have been taken away from the owner. Is it that way where you live? Poor Itchy, RIP.

I'm so sorry!
That is horrible to say the least. I hope that the man that owns the pit bulls calms down. He was probably just in shock or something when he threatened your dad. I feel so sorry for you & your family...what a terrible way to lose a pet.
I hope the owner of the pit bulls has to pay for everything. I don't blame your dad for shooting the dog, trying to protect his own. What a sad situation.

Gosh, I'm so sorry.
