My soon to be ex just stole my car and took it back to the dealership, signed it over and said "we" don't want it anymore! Um hello?! There is no WE! We split up! I called the police and they said there wasn't anything they could do about it because we are still legally married even though the car is in my name and was mine BEFORE we got married, it's still community property.
I dont even know how he found out where I live since I moved!
Im about to have a nervous breakdown!

I tried to get one today before all this even happened. I just called them and they denied it! Said there wasn't enough to grant it

Is there a legal services center there? Many state-funded legal services centers (may be called Florida Legal Services down there) have free ask-an-attorney lines and an attorney may be able to consult with you on what to do.

I am so sorry this has happened to you. It sounds like he is quite the manipulator!

I bet if you called them back and told them about this, there'd be enough evidence to warrant one!
Also it SEEMS as if he's finding you whereever you are moving to. Isn't that called stalking???? I bet there's a law against that!!!!!!

I don't understand how he could sell a car that's in your name. I'm almost certain that couldn't happen here in Canada. If the car is in my name, I have to be the one to sign over the ownership.

That is so unfair! What an a$$ he is. I agree that I would try to find a lawyer and not take this lying down.

I work at a car dealership and I'm quite confused as to how he sold your car, if its only your name on the title? Hmmm...sounds fishy to me!!

Good luck with everything that happens, I hope this guy gets whats coming to him, you don't deserve this to happen to you!!! Best Wishes

I don't see how he could do this either. I know in this state, DMV will not accept a transfer of title unless it's signed by the OWNER of record, and it has to be signed EXACTLY like their records show. Otherwise it will get rejected.

Yeah, sounds like this dealership just broke a couple of laws. B/c in GA even if both your names are on the title you BOTH have to sign it over! My dingaling of a cousin's ex wife tried to do the same thing with his beloved truck, but she was told that they have to have both signatures! (He deserved it in this case.) I would call the police on the dealership for theft by taking as well, or at least threaten it of they don't give you your car back!!

Yeah I really think that's weird, even in the body shop when people's cars are totalled they have to sign the car over to us or the insurance company...that would be like us just signing over a broken car to us, and not the car owner!! I would DEFINATELY check this place out, did you call the dealership? I would call the owner of the dealership or the sales manager and tell them the situation, thats just so weird....in our dealership I have NEVER seen anything like this happen before, I think its illegal!!

I work for Ford Credit and this is what you should do.
First call the place that the vehicle was financed if in fact it was financed. He cannot voluntary surrender the vehicle and have it be "legal" if your name was on the finance contract or the title. Especially if his name wasn't on either the loan or the ppwk.
Who has the title?? I know a "repo" title can be ordered from the DMV by the financial institution.
Was the loan in default? I know in WI after a vehicle was repo'd a consumer has 15 days to redeem the vehicle but I do not know what the laws are in the state it was purchased-those are the laws that have to be followed.
Did you contact the dealership it was taken to?? Can you make the payments by yourself?? The loan could possibly be rewritten to lower the payments by stretching the remaining term of the loan.
Please let me know if I can answer any of your questions.
