My brother Jesse, 17, was driving home from school, carrying three other passengers in his mini-van. One of the passengers, Russel, lost his hat when it flew out of an open window. Jesse started slowing down and pulling over so Russel could get the hat, but instead, Russel unbuckeled and jumped out of the car while it was going about 35 mph! He tumbled down a ditch, started convulsing, and passed out. Russel was taken to the hospitol by ambulence, and my brother was left to face the news crews and cops. Russel ended up with a skull fracture, and can't rember anything that happened. Our insurance has to cover his medical bills, even though it was his fault, but luckily Jesse was cleared of any criminal charges. (The two other passengers saw the whole thing.) Don't you hate it when you have to pay for the mistakes of others?

I'm so glad that your bro escaped by criminal charges....I just don't understand why the dumb kid the jumped out of a MOVING CAR couldn't be responsible for his own stupidity?

I just don't get that at all, you mean to tell me what you are saying is if you and I was driving down the road and I jump out of the car its my fault?????
Sorry to hear about what your brother and family is going threw that is aweful..

I'd be consulting a lawyer to see if ditwad - er - Russell, couldn't be sued to pay for his own stupidity.

I have read several articles recently that recent research shows that the areas of the brain relating to judgment aren't fully mature in most individuals 'til the age of 25 or so. This seems to support that.

that's pretty standard behavior for teenage boys.. that and jumping on moving trains, jumping off bridges into bodies of water without checking depth, etc. They are just weird.

Agent_Haun, That really stinks for your brother. His insurance will probably go up too. As far as sueing "ditwad"
- I mean Russell, as Gemlady was thinking, I don't know. It would be great if he could be sued for being an idiot. In realty, since insurance is covering it, what kind of loss can your brother show? The difference in his insurance maybe, but I don't know if that will stand up.

Wow. Talk about braindead! That one takes the stupid award, hands down.
It might be worth your while to talk to a lawyer-at least see what they have to say, & hope for the best.

Yeah, like my stupid ex boyfriend he just brought a car(for about $100) and then got 'wasted' and then went around driving like an idiot. See why he is an EX?????

I would definitely be discussing this with an attorney, especially since there are witnesses! I for one can believe the stupidity of teenage boys - I dated a couple, then decided to wait until after college.

My mom consulted her attorney, and he said to just let the insurance pay it off, otherwise they could sue us !
Not sure how that works out. Not to mention, Jesse still doesn't want to lose his friendship with Russel, though it's turning out to be an expensive one.

Let this be a lesson. Before driving anywhere with friends, read them the "riot act". Seat belts fastened, arms in the windows, do not unbuckled until car is fulling stopped and engine off...

Darn shame you have to do things like that! (Personally, I blame the testerone...)

Like so many others have said, some teenage boys are reckless daredevils. Gemlady is right. Russell had too much testosterone flowing through his system and clouding his judgement. It's a shame that your brother's insurance has to pay for something that was complertely not his fault. It sounds like Russell's injuries were pretty severe and I feel bad for him too.
