I just found this site and it is amazing. The amount of advice and help is remarkable.
Two months ago my son and I found two stray kitties. One was about a year and a half and the other was approximately 4 months old according to my vet.
I took the kitten in as the older cat did not want to be indoors at all, though I still fed her outside, as most others in my complex did too.
I tried to find their owners. I placed flyers in local grocery stores (small town, only 2 grocery stores), posted on fb cat rescue pages, contacted animal control and reported the lost cats.
For two months I heard nothing. I called AC a couple times a week to see if anyone had called about the missing kitties and no one did.
Three weeks ago I moved out of the complex to a different, larger city in Florida and I took the kitten with me. Everyone else caring for the outside kitty said they'd continue to do so as she became the community kitty. No one wanted her taken to AC as its a very high kill AC.
After moving I got the kitten fixed, dewormed and immunized as I decided to keep her. My 3 other kitties love her, she loves them and she loves my son and I as we love her.
I've been in my new place for 3 weeks and tonight I get a text from my ex neighbor, saying she found the two cats owner and that I had better call the woman and give her back her kitten. She stated the owner lives in the complex I just moved from, but when I received a text from this so called owner, the address she gave me to her house is 6-7 miles from where I found the kitten. Both stories were conflicting.
My ex neighbor is a heavy drug addict and will do anything for money.
I looked up the woman claiming to be the owner and what I found floored me.
In Aug 2016 this lady and her husband were arrested on 3 felony counts of animal cruelty and 2 counts of animal abuse. Per the news article this couple had been caught conducting dog fights, using small animals as bait and cockfighting. Per the judge in the case, neither are allowed to have pets or any animal in their care.
My ex neighbor unfortunately handed the outside cat over to this lady today, without having proof that she's the owner.
The lady claiming to be the owner got my number from my ex neighbor and texted me saying she's been frantically looking for her cats and that I'd better bring the cat to her house and give her back.
When I responded I asked only 3 questions....1 how old is the cat she lost...2 what breed is the cat she lost and 3 is the cat she lost male or female??
The Lady never texted back with answers to my questions. The only text I received was another from my ex neighbor saying if I do not give that lady her cat back then they are prepared to call me in for animal cruelty.
I'm still trying to figure that one out.
My question is, I did EVERYTHING to locate the owners to the kitten for 2 months with no avail. I want to keep the kitten as she's become a special member of mine and my sons little family.
Can this lady do anything legally to me to get this kitten back? What can I do legally to keep the kitten?
I haven't told my son because I know it will worry him, he's autistic and has bad anxiety. And he's become very attached.
I've since blocked my ex neighbor again (blocked her weeks ago but she used a different number tonight).
I just know that in my heart even if the kitten was hers, she's not safe with these people. And the lady isn't able to provid me with any proof that the kitten is hers.
I love this kitten so much and want her to be safe and loved.

You did absolutely right.  The lady case is very thin.  Especielly if she HAS these judgements against her, even forbidding her to own animals.  She shall be grateful the kitten got a good home, as its a common problem, for say hoarders,  whom do love their cats but are very bad owners...

But I wonder, why is your ex-neigbour so engaged in this errand, as if he were a paid lawyer representing this woman??  Did he got a handout??

I wouldn't even worry about having to give the kitten back, given the judge's ruling. If your former neighbor continues to harass you, tell her you're going to report both the "former owner" and her to the police and local animal control authorities because the other cat was handed over to her. If it were me, I'd report it in any case.

I would block her from texting you.  The kitten belongs to you now.  Enjoy the kitty, love the kitty and be done with the others.

You can call the police on her and report she may have a pet if you're worried about the other cat being abused

I would:

* Tell them to leave me alone. No further explination needed. Don't engage.
* Respond no more to either.
* If they continue to bother you after you say to not you can block their numbers or change yours. Same for other contact information.
* If they continue then it is harassment and you can take it to the police. At least where I live, it isn't harassment until you tell them to stop and block them. If they go around the measures and refuse then you can press charges.
* Keep all records of medical care, food, toys, etc for the kitten. It is your proof of providing care. The other person doesn't have a case if they don't have proof of being a primary caregiver. Even if they have photos without vet care and food they have no proof of ownership which requires being primary caregiver. As long as the other person didn't microchip there is little they can do to prove ownership unless the kitten is very unique.

Yes and at some point I'm sure the loving ex owner will want to sell you the kitten.

1 you attempted to find the owner.

2 as I was told when I took in my stray that was likely one of my SILs I will love you and hug you and keep you forever until the first time you go in heat or I just get tired of taking care of you that if you feed them for x amount of time they are considered yours. ( a bit more complex than that but you get the idea)

If this person could prove it was her kitten she would have. If she persists in contacting you I would tell her that I am going to report her. By reporting to Animal Control you covered your backside and iced it by putting up flyers and using FB. One other thing you need to know. Pets are considered property so at the very worst , very worst she could try and sue you and unless this kitten is some purebred that she can ID 100% you kitten is worth what the local adoption rate is. That said do NOT offer her any money because then she can say you acknowledge her ownership.

100% all of the above. Don't loose sleep. Is the kitten microchipped? I would chip her. Then you have more proof of ownership.

People like that lady who told you that stuff about the woman looking for you-just let em know that they have no business contacting you. And if they don't stop-contact police and Animal control and turn her in for looking for animals for fighting.

Thank you for all of your advice. I used to rescue and foster for a cat rescue in GA, but I was under the protection of the rescue if a problem were to arise. I just rescued, fostered and loved as many kitties I could.
I have blocked both parties from my phone. I blocked the ex neighbor after telling her to leave me alone twice. And blocked this other woman this morning since she still never gave me answers to my questions about the kitten.
I'm not even going to worry about it. Its on record at the vet that I'm her mommy, so she can try all she wants to take her.
I'd never pay her for the kitten, she can't even prove she was hers.

Her breed is a torti ragdoll. Absolutely beautiful and sweet. She took to my son and I immediately. :)

StefanZ, my ex neighbor only gets involved with other peoples lives because she's a nosey bitty. She claims to be the greatest servant of God and is doing Gods work by helping this lady get her cat back from me. The only time I've seen this woman pray is when she was begging neighbors for pain pills.
It was a real nice complex until her sister and her moved next door. They are one big reason why I moved my 11 yr old son and I away. I wouldn't be surprised if this other lady offered to give her some type of money award for making me give the kitten back.

I forgot to add, I did contact animal control and police about that lady having the older vat in her possession.

do you have any pictures of this beautiful baby?!

Sad that sometimes people move into a nice area and ruin it for others. And real Christians don't brag about their works. They just do it.  It sounds like you are better off away from such drama and silliness. I hope you guys get settled in and I am sure you are enjoying the quiet and peace instead of listening to busy bodies try to put wedges in between people.
