Help! I need cat help

Hello. This is my first post on here as I am searching for help as I am totally lost. My partner and I adopted a cat back in February from a rescue and since then she has had the best life! On Saturday we got the news she had been knocked over and sadly passed which is very deversating for myself and my partner. Our little girl got picked up by the council the the rescue which her microchip was registered to were called. We have since had contact but the lady at rescue isn't letting us have her back to bury her in our garden and to see our goodbyes to her. I need help on where we stand?? I'm so upset and can't bear to think we can't say goodbye to her as she has brought so much love to our life. At the rescue they advised us not to let her out but we couldn't keep her locked in as a prisoner. I just felt it wasn't right to keep a cat as wild as they are to be locked up in a house their whole life. That maybe just me. I would really like help and advice on this suitation as I really want my little lady back???

I'm sorry to hear about your cat! How sad.

Sounds like in the future, you might reconsider allowing full outdoor access, maybe an enclosure or other thing is safer around there.

You went through the standard procedure of completing an application, paying the fees, etc I assume?

If so then she is your property and needs to be released to you.

At least for California that is how it is, pets are considered personal property.

I think most states are the same.

Strange that they would not give her body back, do you know why? I mean did they give a reason?

Welcome to TCS catlady1990. I am so sorry for your loss. That is so very horrible of the council to refuse you the duty of final care. The difference of outside vs inside philosophy should not be the determining factor. You are most definitely being treated unfairly. I have no idea, concerning legalities. I would go there and not leave without your little lady. Thinking plan #2 is contact a lawyer immediately. Please keep us informed.

I will definitely keep you in formed. It isn't the council it's the rescue where we got our Molly from that are not letting us have her back. I say rescue it is actually one lady in particular. I'm sure she can't do this. She has since blocked my partners number so he can't ring and I have messaged her explaining that we would like her back. If she doesn't get in contact by the morning I will message her again telling her that I am taking legal action against her.
Do you think this is the right choice? Are we in the wrong? Any advice is great. Thank you x

Sorry. The only reason she has given us is that we let her outside.

Some rescues have very strict polices on not allowing cats to be outside wandering.  You might look to see if you have a document you signed stating that you would keep her inside.  I have heard of rescues that stipulate that you must keep a cat inside. 

I am sorry for you loss and hope that you can find closure.  Maybe you can tell her you are going to call the authorities.
