...The real issue here are laws that see companion animals as chattel.
That's why I hope OP can find an attorney that is very knowledgeable on animal laws! I'm sending positive energy to them all!

Okay, now back to lurking. I'll try to add what I can based off of my personal legal experience as a self employed individual, but I'm not at all educated in law. I'm furiously gnawing my fingernails watching for updates!

Oh this is such a distressing thread I'm new to this site but am a lifelong animal lover. On reading the original post my first thought was OMG this girl is trying to make money out of it. Not the OP , I mean the OO. It's very telling that she's shown no interest in momma cats wellbeing or the kittens but suddenly wants them all back once hears kittens have been born. I would bet anything on this she is hoping to sell them. And that's the main reason for wanting them and momma cat back. How predictable that she the OO is now considering selling to the OP for a fee , lol, money money money.
I take it OO has not offered to contribute towards vet fees or food costs since the OP has taken her on.

It sounds like original owners home environment was horrible and abusive for momma cat. It does not sound that she was cared for properly or fed appropriately, esp as OP mentions the scabs near her tail cleared up once OP had taken her on. Maybe a lack of money and lack of knowledge from OO ?
Also the bit about the OO thinking of having her current kitten put down cos her illness or condition whatever is too expensive to treat ! OMG how awful. Don't know about the US but in the UK there are charities and organisations that provide vet treatment or help with costs for those on low incomes and also vouchers towards neutering costs. I take it OO has never insured her kitty...
And initially advising OP to abort the unborn kittens; again I take it no money offered towards the costs, just expecting the OP (who sounds like a kind caring person) to pay for it and organise it then hand kitty back if and when she might want her back.
This is all about money and control.
Poor kitties and poor OP who sounds to have really bonded with them all.
In a way the money and greed factor should make it alot easier to keep the kitties for a fee. As another poster says don't offer too much or OO will sense desperation and play it for all she can. Just enough to get the silly greedy girl to think she has done well out of it. Sad thing is this girl,the OO, will no doubt adopt another cat soon and that worries me with cat abuser uncle jailbird in the house. Also having a bad track record for cat mortality already.. all very worrying. Does uncle give this girl money for anything? She may be beholden to him and loathe to report his animal abuse for that low reason - no more cash cow. Silly that her family have him in their home, blood relative or not, if he is abusive etc.

Would defo meet her in a public place (with surveillance cameras), and record the conversation on your mobile phone. The OO sounds like a liar and manipulator if she has already lied to the police. Cover your ass! Hopefully the money will get this sorted if OO agrees to take a payment for you adopting the momma cat (fingers crossed ).
I hope it works out for you and the kitties.

I would strongly advise to not give momma cat or any of the kittens to the OO girl. Even if you get her to sign a contract saying you can get them back if she is shown to have neglected or abused them, how could you prove that with the girl shown she is a liar already? She would no doubt tell you what you want to hear and make excuses for you not to be able to go to her house and see them to check on them.
It would be nigh on impossible to save them if they went back to the OO.
The original environment sounds so unsuitable and potentially fatal for a cat, please follow your heart and keep them safe ! You sound like you put the kitties welfare above monetary considerations bless you I do so hope you can keep them and if any of the kittens are re-homed by you once old enough (12 weeks minimum), that they go to loving forever homes where they are treated like royalty !

I dont plan to give any of them back unless a judge says I have to. Boyfriend can just be mad if he wants to.
She's agreed to meeting Sunday at White Castle to talk so we will see what she wants then and I'll update everyone on whether we've come to some kind of agreement. And I'll make sure to record the conversation, thanks for the advice on that! If she does want money I'll also make sure we do a money order.

Wow, this makes me think of when I took Sara in. The person I got her from had said that her sister would "probably" take her after she moved to a different apartment. Well, never heard anything from the sister. The person I got her from (a coworker at the time) ended up quitting and moving out of state. That was a year after we took Sara in. Never heard anything from her again regarding Sara herself, or her sister taking her. We took Sara in back in 2006.

I hope the conversation goes well with this other girl. Hopefully she will just let you pay her for ownership of the mama. And I agree, you shouldn't have to return the babies. You've taken care of them 100% and she hasn't paid one red penny toward their care. She never even wanted the babies.

Update!

We talked and she completely changed what she was wanting. I'm not sure if it was just seeing us in person or that I wasnt budging and had proof but we decided that her husband's grandmother can have one of the kittens since they promised her one and she says she will sign the contract and wait until the one she wants gets fixed. I'm still wondering why she couldnt say that in a text or something since it was so different from everything she had been saying but it works out any way lol.
Thank you everyone again for helping me with what to do about this, I'm glad it didnt end up going to court.

Almost always a face to face will produce results quicker than phones, emails and texts. Two dimensional conversations are void of emotion. No matter how many smiley emotions you use. She may have also talked to a lawyer or done some online research. Talked to a friend.

Glad it worked out.

Just remember the agreement....and keep that contract, forever! Make a copy of it and carry around with you--for a while, at least...just in case.

And see if you can check up on the cat you give away....just for their wellbeing...Hopefully, they will not be able to take that cat away from the grandmother...or it could be a lie....just something to think about....

The OO now has her pound of flesh so to speak. Best to leave it alone and see if she ever claims it.  In a very short time she deescalated from calling the police to try and get the mother cat and kittens back.
