Momma is a dilute calico, don't know about daddy... she was feral/stray before she got pregnant and adopted us.

Tummy is spotted, sides are sriped vertical, head and legs are striped horizontal.  Orange and black peach fuzz still on his back.  Face has orange below the ears, and a white mask.  And his bottom lip is black.  Is he a Torbie?

I think so, torbie with white.   He may even end as spotted torbie, if you dont  WATCH out!   With enough of spots on the behind parts, he could be technically counted as spotted...

A male tortie is very rare, are you sure he is not a girl? I think torbie would be the best way to describe him, even though it doesn't seem like the tortie we seem most (as the stripes remain black).

He has not been to a vet yet and I am somewhat inexperienced looking "down there", but pretty sure he is a boy - I have seen pics on the internet.    He is three weeks (not quite three weeks in that pic). He has lightened up considerably since birth so we are anxiously waiting to see what he looks like when he loses the rest of that baby fuzz on his back and neck.  I will try to get my daughter to take another picture of him in a couple days, and one of his backside to confirm if he is a boy.  And maybe a shot of his under belly too... very spotted.

If you want, you can show us his behind and we can double check for you ;)

He kind of reminds me of the color of one of my own kittens. As in your pictures your kitten is a few days and 3 weeks, I'll post example pictures of the same age of a kitten I had last year:

1 day - 1 week - 3 weeks

I remember doubting about her color back then too. she eventually has been registered as a 'Black Tortie Tabby Mackerel with White' (Which she is). However, I and some friends are pretty sure she is golden as well or at least carries the golden gene aside from what she shows, which eventually turned her into this:

(Golden means a red undercoat - much like silver but not white) The only reason  she could not be listed as golden as well was because she has a black rim around her nose. The golden gene is still very unknown and works on ways that isn't very known yet. Your kitten can be listed in color the same as mine has, but there could be some secret gene working there instead of the actual tortie (red and white) (which I don't really see on your kitten). I'm curious if your kitten turns out the same as mine did when it comes to the orange glow on her entire body ^^

What a beautiful kitty.  Momma is short hair so I think Theo will be too but yes, your kitty photos looks a LOT like Theo.  I will try to take more pictures tonight.  my phone just isn't the best.  Might have to wait on my daughter.

Yeah, my kittens have medium lenght fur, but aside from that the coloring feels the same to me! She was my little magic colored kitten, I hope yours will grow up just as beautifully <3 I'll look forward to more pictures!

Here are more pictures of Theodore.  1, to confirm if he is a boy... as you cna see in the top picture, one side he is still very stripped, but the other side is giving way to be more spots. He was born almost black, but his fur is lightening to a cream color.

I am starting to wonder if Theo might have a bit of Savanah cat blood in him.  The Serval cats have very small heads and the big ears, which is opposite of Theo.  He has a pretty big head and small little ears, but his coat is starting to look a little Serval/Savanaish (3rd picture).  He is trying to learn how to hiss...

Ohh, his pattern and color is beautiful <3 I think he's turning into a very nice and warm tabby (He is a broken mackerel). He also does seem to be a boy, but the picture isn't that clear so I don't dare to say it 100% sure. However, the tortie idea seems to have left, so I would go with 'Black Tabby Mackerel with White'

I still would love to see how he grows up, so please don't hesitate to continue to post photo's of the little man!

Are you planning on keeping little Theo?

Well that was not originally our plan, we only let momma in with intentions of keeping her till kittens were weaned, and then getting everyone fixed and finding them homes.  So far we are not having any luck finding anyone who wants momma, and with just one baby, its hard to let him go.  All our cats have always been rescues and fixed so we are loving this little baby... but we already have two cats.  Resident cats and Momma cat do not get along.  Resident cats even hiss at poor little Theo.  I am sure they would adjust to Theo in time, but Momma is mean, and very unpredictable.  Buttercup (momma) and Theo stay locked up in the back half of the apartment and Resident cats get free roam.  We let Buttercup out several times a day to explore the apartment and get exercise - and usually a little face to face time with the other cats, through the screen door to our balcony.  If I am sitting on the floor she will come almost to the screen door and she won't hiss, but you can feel the tension in her body... she will lay down and let me pet her for a few minutes and then - and you never know when - she will fly at the screen door all fangs claws hissing and growling.  Snowy (the deaf rescue from the shelter) will just sit there and look at her and occassionally she will hiss, but Tati (the ragdoll) runs and hides from her, so Buttercup powertrips over that and if she even catches a glimpse of Tati she goes crazy.  They are all my daughters cats.  She ultimately gets to decide if we keep them. Also, we are trying to buy a house.  We made an offer last night so depending on how that goes, we would have a little more room to keep them, and keeping them as outdoor cats would be more of an option than in the apartment (also basement and garage would be options).

Update on Theo, though it is getting hard to get pictures as if his paws are touching the grown he is moving.  Funny little guy has learned to hiss... and this was a long time coming as his mouth has been going through the motions for weeks, but now he has the sound to match.  I just wish he wouldn't hiss at our resident cats as we are still tying to convince them THEO is not SNACKFOOD.  Hard to do when if they hiss at him and walk away he chases after them hissing to beat the band!  My daughter has a new nickname for him.  Theodore is now Theadorable. Here he is playing in the kitty tunnel.

He grew so well!! ^^ I love his new name, Theadorable, he sure is adorable ;)

The hissing against the other cats I wouldn't worry about. It's his way to tell them they are going to far, or he is feeling threatened by them (this can even occur when they aren't doing anything). He is still learning what is good and bad, and eventually he should learn that they are no threat and they will get along better. It's part of his socialization. The other cats hissing at him is also not bad, as it's their way to tell him he shouldn't come near them. As long as they aren't attacking him, just let it be. They all need to adjust to each other.

Well he is turning into a rather normal looking tabby cat, but he is still a cutie (still hoping for the magic color kitty effect... but not holding my breath).  Tatiana plays with him pretty well these days, but Snowy doesn't like him at all.  Its funny, but Snowy tries to make friends with Buttercup (the momma), and Tatiana still can't stand her since Buttercup attacked Tatiana badly the first time she escaped the back bedroom. We try to let Theo out to roam while we are home and supervising... but he is getting so fast!  he likes to explore and hide under the couch.  I would be okay with him hiding under the couch and playing with Snowy from under there, but she still growls at him as well as hisses at him, and she can fit under the couch too.  Momma kitty gets fixed in another week, or two weeks, so maybe after that we can start getting all 4 together.

Yep, Theo is spotted on one side and striped on the other. I think he will end up being spotted on both though, as he grows his stripes are breaking up.  His momma is  a dilute calico and father is unknown.

Tabby is dominant, so it was surely the daddy whom was spotted tabby.
