I finally got some good news today from my attorney! Walmart and their insurance company have admited responsibility and made a so-so offer. I just sent my attorney a counter offer that includes the repair of the car, towing and rental expenses for the last 2 1/2 months. They wanted to give me $5439.24 and I told them I want at least $6139.24, which I think is very fair since I have been without my car for almost 4 months. I just want this over and my car back! And I need new tires, so the extra will buy tires and have a few bucks left. They are really getting off easy since I could havce asked for my car payments the last 4 months plus I charged them $1200 less then I could have for rentals.

The moral of the story....... Don't have your oil changed at Wal-Mart! (Sorry Shell... but at least I might go there again someday and buy other things.)

I hope that they agree with your counter offer! You should make them pay your lawyer's fees as well!

This is where they are lucky. Because my lawyer is doing this for free. He's my neighbor. If they had to pay for him they'd crap their pants! He's known as one of the most powerful men in Utah. I never realized this until recently when I kept seeing things on the news about him and then someone told me. He's a very kind and humble man. I'm so glad he's my neighbor and friend!

wow. i've never had a problem with Walmart doing my oil changes, but that's crazy!

LOL...i have a love/hate/hate relationship with Walmart myself. i want to see the day come when people are willing to pay more for quality goods, rather than going for quanitity....SIGH.

I never had a problem with them doing my oil changes either.... until the one they did in July. And apparently there are many others across the country with similar experiences.

I have had trouble with wal-mart changing oil in our car also. They cross threaded the drain plug and my husband found it and had to replace it. So either he changes the oil or one of the other oil changing places does it.

Tammie, that is great to hear! Glad things are finally moving along, and you'll get a resolution to the matter soon. The pro bono work was extremely kind of your neighbor!

I don't know the story of what happened with your oil change at Walmart, I missed it, I am sorry...but I am glad that it sounds like you are going to get the $ you asked for!

Hi Debby, I got my oil changed at Wal-Mart back in July and 4 days later my engine died. After a bunch of run around from Wal-Mart and the manufacturer I had to get an attorney. Almost 4 months later I'm finally getting my car fixed and getting reimbursed for some of my expenses.

That's ok Tammie. I might work for the company, but I don't always agree with what happens. I'm glad that you finally got it all squared away & the hassle of it all is over.

So, when do you get your car back?

That's such good news Tammie! Your neighbour is a really good person to help you out for free like that. I hope they take your counter offer with glee, as they should obviously be paying out much more in compensation.

I'm still not sure when I'll get my car back. They have to order the engine and it comes by ground. I think from California. So it could be a week or even two. And it depends on how fast Wal-Mart claims sends the check too. They haven't been the fastest but I hope it doesn't take another 4 months for them to cut a check!

My thoughts on this are that it is not much different in cost to have the car dealership do the work for you, and it can make a big difference when it comes time to trade the old one off for another. If you build a relationship with the dealer, you will likely get a better deal at that time.
