 Yep,another rant thread
The kitties are fine its just us that aren't some good news though our cash should be sorted soon and we may even be in for a bit of backdated cash as tax credits pay you on your last years income, well of course dh hasn't earned the amount he did last year so looks like they have been underpaying us.They said it will take 14 working days though as they have to look into it properely.

Anyway my problem is we bought a family car with dh's small redundancy pay as we just could not afford the fuel costs of the other one.We bought it on 30th december, went for a drive in it the next day driving away happily when all of a sudden the turbo cut out,had to pull over re-start the car and carry on.It kept doing it,so we went straight back to where we got it from.He said he would get it booked in to have a look at it,it required diagnosing as its all electrics.Ok so 3 days passed, finally he said he had got hold of an auto electrician who would come to our house, wow or not so wow,the auto electrician phoned and said my dh had to take the car to him and we had to pay?? Phoned the car dealer up up he said oh no the wrong auto electrician phoned us,leave it with him. 2 days later phoned dh,can you come down now the auto electrician was here.He did and it came back with a number of codes which means it could have been a number of things causing the problem.

He then decided to get it booked into ford a week later as they might be able to tell us more. They just did the same and it came back with the same codes but they did tell us what it might be a few things. So the dealer who is not a qualified mechanic ordered some different parts and set about trying to put them on himself and adjusting the turbo wast gauge. I was not happy with this. This failed to rectify it still so he then said he would take it to a diesel specialist as it may be the injectors. 4 days later eventually phoned,dh again had to do all the running and take the car down himself. He promised he would lend us a car,he didn't. I rung him and he said give me an hour I'll ring you back,he didn't.2 days later he rung back to say he would pich dh up to go and get the car.

This garage also couldn't find a fault. We started digging around to find a bit out about the car,he told us it came with service history,it has none.he told us it was from a private sale,he lied he bought it from auction. Ok so he did try and get it repaired we have to give him that but this guy is not honest. He has now run out of ideas and said he will give us a refund and our old car back, brill. So I rung him friday and sad can we arrange the refund as dh wants to find another car,oh no he said I have no money???what??? Ok so when will you have money? He said 3-4 days as he was waiting for a card payment to clear. I rang him yesterday and he said oh no still have no money,I can't magic it out of thin air. I have phoned trading standards, citizens advice and all the rest so know our legal rights.I told him that I had and he said whatever,I told him I had cancelled the insurance on the car-I have but we have until the end of the month as have paid this months,he rang my dh back and said if there is no insurance on that car u had better be careful as if anything ahppens to it the ball is in your court. Ok alarm bells ringing. We moved the car to mum in laws last night out of the way, good job I have a car but its too small for us all to fit in.

I rang him today day 5 he still has no money and now he said it takes 7 days for card payment to clear, sorry but I wasn't born yesterday,I said you told me 3-4 days,he said I do not have to justify the way I run my business to you Ruth and what do you want me to do stay up all night watch my bank and phone you on the 3rd hour when cash goes in?OMG I am fuming, how dare he,we have a car that is dangerous as it cuts out and he offered the refund and now he is fobbing us off. He left it at he would phone us in the next 24 hours.

We can't afford a court claim for this and its making me so ill,I just want to cry,I am so mad at him he is an arrogant, lying
Oh and he has sold our old car that we part exchanged,he gave us £900 for part exchange and he told me it had to be scrapped as it was rubbish, omg what a load of rubbish we just had the car mot'd and a load of work done on it,CAB said it doesn't matter though he has to give us the £900 as he allowed us that and its documented plus the cash for the car.And for saying he has no money he has a lot of new cars on his website that are obviously from auction. I cannot take anymore,I really can't,what would you do?x

WOW!

If he sold your old car where is the money from that?  Does he work by himself or does he have employees?

Is it a Ford?  You should be able to contact a Ford dealer or, if not  whatever manufactuer and find out if there were recalls on the vehicle  Any dealer should be able to contact a company representative to find out of there were recalls were they ever fixed.  Can you find out the name of the auction that this vehicle was purchased at.  Maybe they could tell you the condition of the vehicle at time of auction.  In the US if a vehicle has been out of service for a certain amount of days here in the states we call it Lemon Law the company can end up buying the vehicle back.

Does this place you bought the car from have some sort of business license or is there a place you can complain to about business's like his?

I used to work for Ford and have a bit of insight (but this isn't the US).  Hope this info helps.

He's just a garage that sells second hand cars.Ford can't do anything as its a 2nd hand car. We are limited to what we can do,trading standards said that we can't force him to give the cash back,we would have to take it to court. We really cannot afford legal fees for the small claims court. Well dh is phoning him in a minute, its been 24 hours and he hasn't contacted back yet,I think today we will do what my mum said and just go down there and refuse to budge until he pays us.Scary stuff as he isn't the nicest man in the world but its ok for him,he has our cash. He would have had to give us our old car back but because he has sold it he will have to give us the cash that he allowed us for the part exchange on it which was £900,its all documented and so he can't back out of it. I really could scream.x

Thanks hun,it seems that you have better procedures in the US,all we have really is citizens advice and trading standards,I have reported him, also done him a lovely google review so if anyone googles his garage they will see the review
He has another man that works with him, think they are brothers, they are both as bad as each other and can be very intimidating. My dad works at Kia and he has some knowledge also but he has said apart from brute force (which is not recommended, nor correct, even though I feel like slapping him right now) there's not much we can do apart from court. He is just trying to buy time because the warranty runs out at the end of march, also the tax runs out at the end of this month and insurance. i would take the car back to him but then we are stuck with nothing and the car would still belong to us until we got the cash back and knowing him he would damage it or something. Its a no win situation for us.x

In most cities local newspapers we have a letters to the editor section.  If you have something similar I would write all what happened or even better approach local television station to do a report on this place.  Bad publicity will hurt him even more and expose his poor business practices.  Or if you have the time I would stop in his place every day and really annoy him.  I would also put a big sign on that car where the public can see it stating something to the effect that this is a place not to do business with.

I would still think Ford could check if there are outstanding recalls on this vehicle.  I know that lots of vehicle that are purchased at auto auctions came from car rental places and should have been maintained pretty good but who know how the person renting the cars treated the car!

Well, a lot has happened,my dad who sells cars also and works for Kia has found out that these two men are not nice people and not really to be messed with (great
). The man at the garage rung up saturday and told dh that he is to take the car back this thursday but he is to go on his own (very odd) and that he would have to probably give the other man a lift to the bank which is in another town (also very odd) also he couldn't tell dh if he would get the whole refund as he is just coming it saying that we may have caused the fault on the car (***?) so anyway I spoke to my dad and he said no way dh is not to go down there on his own,my dad is off wednesday afternoon and he is going to go down and talk to the bloke and find out what's going on. My dad doesn't accept people messing him about so we will see what happens.x

To be honest I'm dreading it,I just want the cash back so that we can get another car. I just have a feeling he won't give us the full amount or want to.He said that he sold our old car for scrap, well thats odd as I have looked on the motor insurance database today and it seems that our old car is insured so he has obviously sold it. He is just a con man and its making dh worried about what he is like as he is very intimidating. Me,I am just angry and I hate to feel like a mug,I really hope we can get this sorted but I have a feeling that its gong to take a lot.x

Wow! That sounds very creepy to me!  Maybe I watch too much crime drama on television, but that raised so many red flags with me!

The last I heard you could do interbanking, so not sure what this whole "bank in another town" is about.  Way too creepy in my eyes!

That is exactly what I thought, very odd. I feel ok now knowing that my dad is going too. I just have a feeling that it won't be straightforward at all. He could drive himself to the bank, why does he need my hubby to take him to the bank?x

So glad that it worked out!!!  I was really thinking that it sounded like a lost cause and would be a lesson of hard knocks.

Now if you guys have a Better Business Bureau, or something similar, write in a complaint so that it is on record and if others check they will be forwarned!

We did go to the citizens advice bureau and they have been reported to Trading Standards, apparently these guys are well known already, what gets me is how they can still go on trading. I really thought we would have to go to court but my dad happened to know a few people that do not like these guys at all and would love to settle scores with them
If it wasn't for my dad then I don't think we would have gotten anything back off them.x

Your dad seems like a good person to know!  Glad it got all sorted out and you got a different car.  Hoping you won't have to have any other contact with them again.

He is, my dad would do anything for me bless him. The new car is brilliant, thank goodness and haven't heard anything off the dodgy car traders, so all is good.x
