Gosh I'm nervous. Need some vibes.

In 2008, we had all of the floors in my home replaced with a lovely bamboo flooring. In early 2009, I noticed that the downstairs floors were not looking so good, and over the next few months, they totally "failed" and were all cupped and coming off the concrete slab below.

A long battle began with the flooring company, who blamed ME for the loss, saying everything from a door mat under the litterbox to leaving a window open upstairs one day caused the floors to fail. In fact, they hadn't followed the installation instructions, and the concrete slab absorbed moisture from the ground underneath, and caused the failure.

Many letters from my attorney friend later resulted in them agreeing to replace the floor and they began demolition last year, but then refused to honor that contract, saying we had a fireplace leak and we were intentially misleading them all along! Well, I had a general contractor, a chimney expert and my insurance company evaluate that, and none of it was true. Again, it was their installation that caused the problem.

We hired a new, local attorney in January, and tomorrow we will go to court. Last week they indicated they were wanting to settle out of court, but refused our settlement offer. It's possible they may still settle, but with each passing minute, it becomes less likely.

I'm nervous, as I will be the first witness called, and I've never done anything like this. I can be fairly expressive and have a good command of communication via the typed form of communication, but verbally, especially in a stressful situation---YIKES!

So, if anyone can spare any vibes--especially that the whole thing gets settled nicely BEFORE trial in the morning--I would appreciate it. We are scheduled to appear before the judge (no jury!) tomorrow at 9 am. This suit can potentially net us well into the 5 figure range, so it's not a petty thing, at least to us!

Channel your annoyance to settle your nerves; just keep thinking that you are not the party at fault and deserve damages. Good luck!

Just take a deep breath, think about what you want to say and talk slowly. Try not to get ahead of yourself and you'll be fine. Remember why you're there and how important this is to you.

Thanks everyone. So far today I've polished my toenails (fuschia!), colored my hair, cleaned downstairs, completed my continuing education for my professional license...

So trying to keep busy.

I'll pick up my dd in a bit, and then my attorney is coming by the house to "brief" me. He lives 3 doors down from me and will stop on his way home. I keep hoping they'll settle, but so far nothing.

My attorney friend who helped me last year is an excellent attorney and says unless something goes VERY VERY wrong, the judge will rule for us. This company has been involved in at least 5 suits and has lost them all, so they have a history of shoddy work and don't seem to learn. And of course, if we win, there's no guarantee they'll pay up.

UGH UGH UGH.

I'm trying to stay calm....

Your story totally sounds like something out of Holmes Inspection...Im addicted to that show. DF and I watch it so much we could build a house up to code in Canada....eh

LOL--we thought about writing Holmes!

I slept about 7 hours last night, which really surprised me. I have my dd up, fed and ready for school and a neighbor will bring her home today.

The atty went over everything and I guess I'm as ready as I will be. As he said, I just have to tell the story. I REALLY hate public speaking of ANY kind.

Keep those vibes coming...I really will need them to stay calm and speak clearly and concisely. Wish I could hold one of my kitties while I testified!

WE WON!!!!!


Oh, it was a miserable day. I testified for over 2 hours, lost composure once for a brief moment when he asked why I delayed installation of new floors and I told them about having chemo, blah blah. Our supposed "star" witness acted very strange, almost "tampered" with and I thought it was all over then. I emotionally gave up at that point.

We were awarded damages and court costs. Not quite all we asked for, but much better than nothing, which I was in fear we were going to get.

Thanks for the vibes. Several times today I thought of TCS and how nice you all were to support me.

Now---going to dinner and just need to REST!
