Paypal dispute

Ohh man, I am fuming right now


I sold my old Samsung Captivate on eBay because I switched to T-Mobile and don't need it anymore. It was marked as-is and no returns accepted because of the external damage (which I documented and clearly marked, I happened to fall while holding it and chipped the corner). The auction ended in early June, it was shipped out, yay.

Fast forward to July 16th when the buyer opens a dispute with Paypal, claiming that there's internal damage to the phone and it doesn't work at all. I responded to his claims with proof that the phone functioned, the text of the original auction, and a link to the auction as well as asking why he waited over a month to decide the phone was faulty. I also provided proof that the phone was functioning in the form of photos I took with it after I fell- the information for that can be found in the properties of the photo itself. If it doesn't work at all, HOW was I able to take those photos?

PAYPAL SIDED WITH THE BUYER.


It's so obvious the buyer is scamming me! He provided NO proof and I provided plenty- and now I'm out $200. The phone is going to be sent back to me and I am honest to goodness afraid I'm now going to be stuck with a phone that he damaged.
I called PayPal and left them a message regarding the case, called eBay, AND called my credit card company to block any incoming charges from PayPal. I will not let this scammer get the best of me!

Now I have to sit on my hands and wait for the phone to get back to me.
There is no way I'm going to let this happen... I've got my claws out now!!
For shame, PayPal.

Has anyone else had any experience with a similar situation? I could use all the advice I can get!

Stay on them! (Paypal) It is now owned by ebay. I had a similiar thing happen and ebay suspended my account until I continuously hounded them about asking the buyer to send them the back of the box, which matched up with the write up in the auction. This was way before ebay bought paypal. I had to remind them about 3-4 times. The buyer could not produce the box and ebay finally relented and unsuspended me. You have to stay on top of it.

From what I remember, ebay now has seller protection??

I've never had that issue, but it sounds like a pain in the butt to have to deal with. I agree with not letting up, keep calling and emailing. Good luck!

I'm sorry that you are going through this.

My suspicion is that he will claim that he sent the phone back and that it got lost in the mail.

I've never bought anything on eBay, and it's stories like this that is the reason I never will.

I would never buy anything on ebay, I don't trust people there or on paypal. I will never ever use them for buying or selling.

I buy all the time on ebay only sold a time or two. When I did returns it has to go delivery confirmation and insurance just to cover my butt(or the items I returned all did but they were really beat up clothing and a few complaints were opened for fake coupons and one total failure to send anything).

Keep up on them if your feedbacks good and you have sold a few times in the past you have the upperhand imo. Maybe take it to be looked at from your carrier if possible on return that this phone is damaged due to the fall but fully funtional.

Tryi to not let this ruin your ebay experience...theres bad in everything in life but ebays saved me a TON of money and can get hard to find items. for you

I called and spoke with the dispute department this morning. Basically, they told me that whatever proof I provided and whatever I said in the auction meant nothing. They "reviewed" it and still decided that the buyer had the better claim, so... now he has 10 days to send me the phone back. If I don't receive it within that time period then he loses automatically- but if I do, I have to then take it to AT&T and have them write me a letter stating it's fine.

... which it won't be. Because he broke it.

Im going through the same thing!!

a buyer bought a game off me it didnt arrive so i sent a second game (stupidly not recordeed delivery) and he set up a dispute case so now he has two games and his money back ebay and paypal NEVER side with the seller.....the phrase that pops straight to mind is the customer is never wrong which sucks.

So im now going to wind down from selling on ebay because im now a lot of money out of pocket.
