So mad!!

So yesterday I had surgery, and since our house is for sale I had been telling my husband to call our agent and tell him no showings for at least a few days until I get back on my feet and can help get the house ready. Well, he forgot. Anyway, while I was in surgery yesterday my husband gets a call from our agent saying there was a couple and their agent at our door, wanting to know if they could go in and look at our house. We have a sign on our front door stating that ALL showings must be scheduled in advance with our agent, which is probably the only reason why they called in the first place.

Well, my husband told our agent no, that I was in the middle of surgery and our house was a bit of a mess (laundry, beds unmade, dishes in the sink, etc...I had planned on getting it all cleaned the day before my surgery but I didn't get around to it, plus we weren't expecting showings anyway, so we have the right to have a messy house on our own), so NO, they may not go in. He told him they needed to schedule a showing for later in the week. Our agent was apologetic and agreed, telling the other agent that they weren't allowed to go in.

We get home from the hospital, and my husband can immediately tell that they came in anyway. They locked the door differently, our son's bathroom door was open, among other things, and the agent left her card on our kitchen counter. I was SOOO embarrassed that they saw our house in the condition it was in!! For pete's sake, I had left underwear on the bathroom floor after my shower that morning and I had a bra hanging on the closet door knob!! Plus, the litter box was a bit stinky (needed a complete change) and needed to be scooped.

What would you think or do?? I think they trespassed, especially since they were specifically told NOT to come into our house. We called our agent as soon as we found out that they had come in, and he was beyond pissed off. He was going to contact the other agents manager as soon as he could, but we didn't get a hold of him until around 5pm on Friday night, so it may not be until Monday before he does. I'm just so mad!!!

Oh no, that is totally wrong and how would the agent cover up if they do put an offer in? That is totally disrespectful, I would phone up and complain for definite, its your home.xx

As a real estate broker, I advise you to examine your listing agreement. In most cases, signing that agreement with your listing agent gives them written permission as part of the contract to market and sell your home for you. That includes showings.

I agree it was rude, but IMO, they did have that contractural right.

We have it in our listing agreement that showings are only to happen with our permission, hence the sign on our front door stating that all showings must be scheduled in advance. At the time we listed, we had an 11 year old son that stayed home alone during the day (I'm no longer working, and he's in school now), and I didn't work on Wed and would sleep in, and we didn't want people to come into our home while our son was home alone or while I was sleeping. So no, they did not have a contractual right, and how would they know if they did or not? Our agent told them no.

Wow i would be beyond mad! I would be furious! Buying/Selling houses is a stressful time already without having this happen to you. I hope you complain strongly about this as if it is in your agreement then they have no right to enter your home. Disgusting.

A few years ago we had a similar thing happen. The house had tenents. we had signed an agreement with the realtor, that 24 hours notice must be given to the tenents. He brought someone in with out notice. Our tenent was home sick with the stomach flu. She woke up to find them in her bedroom. It was our realtor who showed the house, he knew he was wrong. I told him if it ever happened again, we'd be listing with a different realtor.

I don't know what you can do about it - but the other agent better get a good dressing down from his/her manager!!!!!!!!

That was totally unprofessional of your realtor.

Reminds of when my Mom was selling her house a few years ago. She had already moved in with my brother. She found out that another realtor had given the lock box key to a prospective buyer, and told them just to go and see (and ENTER) the house when they wanted to--without that realtor being there with them!

I think I would call the realtor that invaded your home and chew him/her out, especially if you'd told them they could not enter the home. Good grief!

Make them take the lock box off! That way there is NO way for someone to come in!

BUT it will take longer to sell your house due to so many of the showings being spur of the moment kind of thing. "Hey we are in the neighborhood lets go see that one"

If you have that outlined in your agreement, then if the agent who showed the place was a member of the listing firm, they are in breach of contract and you can essentially fire them and hire a new listing agent. That's what I'd do - they are supposed to be looking out for your best interests, not their own.

That is completely not cool.


The last place I rented as a student, our landlord decided to show at 7am on a school day with the only warning being a call left on our machine at 5am that day. I used my stereo as an alarm (and also so I didn't have to listen to my roommates getting ready) so the "visitors" opened my bedroom door to me standing half dressed making my bed. I shrieked and grabbed a pillow. They looked so baffled and embarrassed, but the landlord kept on showing my room and saying how much cleaner I kept it than the boys with me standing there in jeans and a pillow.

The mother of one of the renters-to-be, obviously looking to fill the really uncomfortable silence asked me how I liked living there. I told her it was a nice neighborhood as long as you didn't want parking or privacy. I looked at my landlord at the last bit, but it went completely over her head.
