Breeding/Showing Contracts

Hi everyone,

Many of you have probably read my last thread in this forum about the sticky situation my friend is in with the buyer of her kitten.

The breeder sent her a copy of their breeding contract which we're going to edit for her to make sure everything makes sense (language barrier, so not all points are clear in the present contract).

What are some VERY important points to have in the contract?

Knowing the whole situation and what this lady is up to, is there anything we should add to help us if she does breach the contract? Like who is to cover the court costs, etc.?

My friend and I are 99.9% sure she is going to breach the contract and breed the kitten to a non-registered cat, so this contract is very important in helping the breeder obtain their rights to protect and take the cat back.

Although we don't agree with what the breeder has chosen to do, we care a lot about the kitten, so we're willing to help them and ensure they can take the cat back in the future. We want to make darn sure the breeder's butts are covered.

This may sound harsh, but I don't think that you or your friend should be in the middle of anything anymore. The breeder allowed your friend to sell the kitten because they "could not" take it back. Your friend found out that she was told several lies and notified the breeder. If the breeder of the kitten now wants to have a contract with the new owner, those are the people that should be working out the details. Breeders work with people all over the world and yes, there could be language barriers. But, those can be resolved if the breeder and buyer work through any misunderstandings.

I understand that your friend still cares about the kitten, but it might be best to step back and let the breeder and the new owner work through the contract details.

I also have in my contract that I will take a kitten/cat back -- no questions asked, no time limit -- or help to place the kitten/cat with a new owner and a contract with the new person. I have brought 5 cats/kittens back over the last 5 years.......... it was my decision, but I made the room. This was my choice. They all have new homes now and I have contracts with the new owners. They have wonderful homes and I know they are loved pets.

I agree with Lynda - you guys need to just step out. Most of us agree that the cat in question should not be bred period. And there is no way to really enforce someone to breed or not to breed to certain cats.

When you hand over a breeding cat - it should be to a trusted individual - otherwise you neuter/spay. Just tell your friend that you are out of it and so should she be out of it.

Its between the original breeder and the byb breeder now - knowing the byb will not honor the contract, why even do one?

Of course all facts probably haven't been disclosed about this situation, but I don't understand why the breeder couldn't take the cat back in the first place.
If you breed cats and sell the kittens, then you need to take the kittens/cats back regardless of circumstance when that need arises......period. If you can't or are unwilling to do that, you need to stop breeding cats.
Everybody's definition of a responsible breeder is going to differ in small or significant way, but I think it is clear to nearly all people that a responsible breeder will always take their cats back, irrespective of the reason why, so that they don't end up in a shelter or the wrong hands.

Hopefully this breeder is getting a wake up call with this, and will adjust his policies accordingly.
