Can they fire him

So DH still hasn't passed his kidney stone. He's still taking vicodin because it hurts. Well he went into work yesterday and they sent him home, won't let him work on vicodin. He told the office lady it hurts too bad not to take it so she said he'd probably need to be on short term medical until he's better. So DH assumed he wasn't supposed to report to work today but his boss apparently expected him there. DH called his doctor and they are going to write him a note excusing him for yesterday and today but DH is worried he's going to get fired for a no call no show today. I'm guessing they can't legally fire him because he has a medical reason for being off work, plus his boss told him he can't be at work on vicodin.

Yes, probably. To do that you need to have a note from the doctor telling them that he needs X number of days off.

Never assume anything.

Rightfully so because he didn't call in and didn't have a medical note from his doctor indicating that he needed time off of work due to illness. The office lady isn't his boss, so yesterday he should have talked to his boss and then called in today and talked to his boss again.

Actually if they want to be sticky about it, yes they can fire him because he didn't phone in sick and didn't show up for work when he was scheduled to. I hope they don't though and that they accept the medical note defacto (after the fact).

The office lady must be the human resources person or she thinks she is. She could have told the boss what she told your husband. I hope everything turn out fine for him.

Great! Make sure you tell him to never assume anything when it comes to his job. Always better to err on the side of caution and call in. And even with a doctor's note given to his work, tell him to call in periodically to give updates as to how he's doing.

Yeah, this isn't the first time he's been off and not called in. He's so bad about that.
