Yeah, the right to use force and be protected from civil lawsuits by idiot criminals injured or killed in the process should go without saying. This is one bill I support 100%.

I think that the judges who allowed those types of lawsuits that benefited the criminals should have to step down.

We have this in Florida, thank God..
SB-436 corrects a serious problem for citizens who chose to protect themselves in the face of attack by violent criminals.

This bill REMOVES the "duty to retreat" in the face of attack; it creates the presumption that an attacker or intruder intends to do great bodily harm and therefore force, including deadly force, may be used to protect yourself, your family and others in the face of attack; it prohibits prosecution for defending that which you have a right to defend and prohibits civil lawsuits by criminals or relatives of criminals when criminals are injured or killed while attacking law-abiding people.

I love 1 thing about North Carolina. Someone does not even have to be in your house. If you catch them stealing your car, you can shoot them with whatever you have on hand. My personal favorite was as Smith & Wesson model 29, but had to sell it, it was giving me a hump back. Now I like Ruger's GP-100.

How dumb is it that you need a law? In this dumb litigious society today, when people get sued for everything under the sun, I guess it's necessary to tell those dumb judges that someone has the right to defend themselves and their property, and shouldn't be sued should the bad guys get hurt trying to commit a crime, and to tell the dumb law enforcement people that victims of a crime shouldn't be treated like criminals because they defended themselves and their property. That's about how dumb it is. When the system has gotten so dumb that it doesn't remember and honor basic rights.

Getting off my soapbox, I'll relate a story about something that happened in Green Bay: someone broke into the home of one of the Green Bay Packers -- one of the running backs. He called 911 and they told him to lock himself in his bedroom. He did that, but then the burglar started to force entry into the bedroom. He unscrewed a bed post and when the bad guy came into the room he whacked him over the head with it. The story has a happy ending: no charges were filed against the Packer because the police determined he used reasonable and justifiable force in protecting himself. The bad guy is in jail with a very bad headache.

And the story just reinforces the fact that most criminals aren't too smart. Who would be stupid enough to break into the home of an NFL player?

I think a more appropriate question should be: how dumb are the American judges that protect the criminals and throw the victims under the bus?

Nuther story. Texas has such a law. A while back a man in a drunken stupor starting banging on a house door in the middle of the night wanting to use the phone to call a taxi after his "friends" had dumped him in the middle of a residential neighborhood. Home owner, "in fear for his life" shot through the front door and killed the guy. Homeowner was not charged.
