Another case of taser abuse...or stupid driver? (warning: video of man being tasered)

Here are my thoughts:

Both men failed to communicate properly. The driver was obviously aggravated at the situation, but failed to hamper it down before addressing the officer. The officer failed to try and speak calmly to the driver, in order to alleviate the aggravation the driver obviously had.

My biggest issue with this whole thing is this:

When the officer asked the driver to step out of the car, the driver obviously assumed (wrong thing to do, IMO) that he and the officer would go check out the speed limit sign (this is apparent by the conversation taking place before the driver was asked to step out of the car). The officer then told him to place his hands behind his back, twice, then pulled out the taser. After asking the driver a third time, and the driver then walking away from the officer, the officer tased the driver.

Not ONCE did the officer state that he was placing the driver under arrest, until AFTER he had tased him. He then refused (or made the implication of refusal) to read the driver his rights once he was placed in the police car.

Both men could have handled the situation MUCH better, but I think the police officer got a bit too jumpy, and should have known how to take control of the situation, without using force. However, I don't think it was ABUSE...just misuse.

I say he should have done what the cop said, WHEN the cop said it.

You don't argue with cops, when that cop told him to put his hands behind his back, he blew him off, BIG mistake. I think the guy shouldn't have gotten a darn dime.

I agree ckblv. And to be honest if a cop had a taser, gun, night stick whatever in his hand and drawn I will do as the officer says. Thats just me and yes I have been pulled before.

Aside from that if the guy did not agree with the ticket he could have just signed and fought it in traffic court. He might have won or he might have lost but he would have had a say in it.

I have to agree. I honestly don't believe any police officer(s) go around tasering people who don't try to fight or make a run for it or do something else as stupid.

It's way past time that people start taking responsibility for their actions and the part they play in what happens instead of blaming the big bad policeman.

The police officer didn't follow proper escalation techniques. The person being arrested was being an idiot. So, in this case, it's a grey area.

I'm not a huge fan of tasers to begin with just because people have died from their use in the past.

Furthermore, the prosecutor's office said that the driver, Mr. Massey, did not commit any criminal actions during the traffic stop!!! there isn't supposed to be a police state in this country

err, hmm yea well, its been that way for about 20 years.

anyway, i dont see any reason in the video for the cops to do what he did.
the man made no threats, to the cop or others, The cop at no point stated what was going on.
he appeared to me that the cop just pulled it out and shot the man.

I took it as, he tasered the guy because the guy ignored his directions.

I think the cop "jumped the gun." I realize that there are only seconds to make decisions in that situation and he was alone; however, he is the trained professional and I think he messed up. I think he may have even regretted it shortly afterward, while the "suspect" was begging for him to look at the stop sign.
