My apartment complex just sent out a letter setting a curfew for the following age groups:

1. Kids under 16 have to been off the property and in side after 9pm.

2. Kids from 16 to 18 have to be off the property and in side after 11pm.

If they are stopped by security then they won't be released until their parents come pick them up. If this happens twice the family will be evicted.

Why do I have a feeling that some parents are going to be up in arms about this?

Hmm I don't knw how legal that is. I mean you would have to check with the local laws but I don't know about that. escpecially if you are paying rent to live there. But I think it is a good thing to have a curfew set for the kids.

WHAT!?!? Kid's 16-18 inside by 11pm that's crazy! I really don't agree with this at all! If I lived there, I would be very mad even though I don't have kids!!! As long as your not doing anything wrong, then why be so strict?

Is that the personal curfew that was set by the building manager/owner- or the city? I know that our town has a curfew like that for kids under 18- certain times for certain ages to be home by.
It was like that back home when I was growing up too, I didn't mind, I think its alright.

Do you have a city curfew? How can they legally hold any child like that? I dont think someone consulted with an attorney before they sent that out, but I could be wrong.

I don't know how kosher that is...it's one thing to have a curfew, but another to say two violations will result in eviction.

Why do I get the feeling that this is probably targeted at someone specific and won't be universally enforced...that and I can see kids under 16 that are presumably in school and dependent on parents, etc, but someone 16-18 who very well may have their own job and life? In a lot of places that's old enough to get married.

Some 16 to 18 year old have jobs that won't let them be home at that time (fast food/weekend jobs, etc). It just doesn't seem fair!

I have the same feeling... it seems to be targeted at a specific group of kids. To be honest DH and I are in bed no later than 11:30 most nights and we live on the 12th floor so we don't hear a whole lot of noise.

I have a feeling that this could be challenged in court and that my apartment complex would loose. Especially if a kid is just coming home from work at 1am. When I was 16 I know I worked that late.

EDIT: I don't know about a city curfew. It's been quite some time before I had to worry about that.

I think that's CRAZY.

At 17, I was a single parent, with two jobs, and I came and went as I pleased. If I was threatened with eviction because I was coming in from my 2nd job - I mean, PLEASE!

Lots of 16-18 year olds have jobs where they have to work until 11 at night. So if they don't get home until 11:30 they aren't allowed to COME IN???

I can understand not wanting crowds of teens just hanging around, but the ones that cause trouble usually aren't the ones that just hang out and talk.

I'd write to the city about it - if there is no city curfew, then the building owner/manager should have NO RIGHT to impose such a curfew.

I was in the elevator today and heard some other people getting upset about it. I have a feeling that the apartment complex is going to have some real issues inforcing it.

And they can't hold the kids. Something to the sound of unlawful inprisonment comes to mind. Or even kidnapping if the lawyer wants to get creative.

In most rental properties, the management has the right to prohibit certain behaviors. It sounds as if there some troublemaking teens in your building and the management is putting them on notice that their behavior won't be tolerated.

Here in Tucson, the City Attorney's office has a department that handles landlord-tenant issues. Check with whatever entity in your city that deals with this and find out just WHAT the property management can and can't do.

MY lease says that I can be evicted, if I engage in illegal activities on the property.

I agree with this. I think they could probably get by with enforcing policies against loitering (which is usually targeting kids of that age range), and possibly tresspassing in certain areas. They may even be able to get by with enforcing the eviction, given that they've notified the whole place of their intended policies.

However, they could never get away with forcibly holding a minor (or even an 18 year old) without the help of police. Police will not get involved unless city/county/state laws are being broken. Nothing the complex has expressed so far is a law. They are only policies relating to the site.

Yeah, when I was 17 and 18, I would often work until midnight or later, and I was definitely allowed to stay out later than 11 p.m. on the weekends, given my family knew exactly what I was up to...I think a lot of people will probably bring this to the management's attention.

My neighborhood has curfews like that I think. I know no one is supposed to be hanging outside their home after 10 or 11 I think. We have it because people are just rude and irresponsible there. But we don't have any form of security driving around to enforce it either.

Firstly, I don't know about there, but here they can not add anything to our lease agreement without my consent, and if I give that consent, I still have 5 days from the day of signing to inform them that I wish to take back that consent.

Secondly, they would be better off with a loitering or illegal activity clause which more people are likely to sign than a curfew. As for the apartment building holding them until a parent picks them up, it could be kidnapping unless your city has a curfew and they are going to have the police come and inforce it rather than the apartment building staff.

This sounds about right, most likely there have been issues regarding property damage and vandalism. It is unfortunate but most likely once the basic problem is taken care of the curfew will fall by the wayside.
Sometimes all it takes extra rules and regulation for awhile just to get a point across.

I daresay it would only be enforced when the kids are being noisy or acting suspiciously. I can't imagine if there was a 17 year old coming home from work at midnight, and just going from their car to their apartment that security would stop them or even look twice at them.

It's definitely a very badly worded notice - it should make it clear in what circumstances security will try to take action.
