Sometimes we are petting her and she will turn around and bite - sometimes she will kick at the same time.  She will also give us  a sign that she will bite, we then stop the petting or whatever we're doing.  She has rarely bitten without being petted.

I guess this will sound too simple - do you have more than one litter box?  I would have at least three for two cats.  That way, a litter box will always be available.
