I was at a friends house tonite ...and they said they would take her in if they will surrender her.   I just have to let them know that someone else would do the right thing by this cat!  I will have my hubby call and leave yet another message--they can surrender her to a loving, good family...

Thanks for your replys!  I am going to have my husband go over and talk to him and let him know he's violating MN statutes by not providing for her and offer to take her to the vet or a shelter.  Hopefully that will help...thanks to all for your advice and replys in s.o.s also.
